Repair Warranty Information Mosquito Control Technology repairs, (excluding carburetors, filters / screens, and fuel lines, which are addressed below) are warranted against defects in material or workmanship for six (6) months from the date on Mosquito Control Technology’s Diagnostic & Repair Report. This warranty does not cover normal wear and tear and shall be null and void if the equipment is modified, improperly installed or used, damaged by accident or neglect, or in the event that any parts are improperly installed or replaced by the user. If Mosquito Control Technology determines that the product returned for warranty service is not defective as herein defined, the BUYER shall pay all costs of handling and transportation. Since carburetors, filters / screens, and fuel line wear is part of normal operation, the carburetors, filters / screens, and fuel lines are not covered under this warranty whatsoever. To the extent that it is determined that failure to follow the preventive maintenance schedule and procedures listed in the Operator's Guide shall have caused any defect in the Mosquito Magnet for which a warranty claim is made, this limited warranty shall be null and void and the user shall be responsible for Mosquito Control Technology's current charges to repair such defects, at regular service rates. Batteries purchased from Mosquito Control Technology are warranted to be free of defects in material and workmanship for 1 (one) year from date of purchase. In the event of notification within the warranty period, Mosquito Control Technology will replace the defective battery provided there had not been damage resulting from user abuse or neglect. Mosquito Control Technology's sole obligation under this warranty shall be to furnish parts and labor for the repair or replacement of products found to be defective in material or workmanship during the warranty period. As a condition of this warranty, the user must: (a) obtain a Mosquito Control Technology Return Material Authorization (RMA) Number for the product or subassembly(s); (b) ship the product or subassembly(s), transportation prepaid, to the authorized service location; and (c) include with the product or subassembly(s) a written description of the claimed defect. Unless Mosquito Control Technology authorizes return of the entire product, the user shall return only the subassembly(s). Products returned shall be packaged in the original packing and shipping container or comparable container. In the event the equipment is not so packaged or if shipping damage is evident, it will not be accepted for service under warranty. Surface transportation charges for the return of the product to the customer shall be paid by Mosquito Control Technology within the 48 contiguous states and the District of Columbia, if products found to be defective in material or workmanship during the warranty period. Customer shall pay shipping costs, customs clearance, and other related charges outside this designated area. The above warranties are in lieu of all other warranties, expressed or implied, oral or written, statutory or otherwise, including any implied warranty of merchantability or fitness for a particular purpose. No salesperson, representative or agent of Mosquito Control Technology is authorized to make any guarantee, warranty, or representation in addition to the foregoing warranty. Mosquito Control Technology shall not, under any circumstances whatsoever, be liable to buyer or any other party for lost profits, diminution of good will or any other special or consequential damages whatsoever with respect to any claim hereunder. If customer does not purchase additional shipping insurance, the "FREE MM TUNEUP" pre-paid shipping label will be created with no insurance of any kind. The customer assumes sole responsibility for the package(s) until it arrives at our facility and is signed for by a Mosquito Control Technology employee. If package(s) is/are lost/damaged MCT must be notified within 10 days from expected delivery/delivery date of package. In the event of a package being lost/damaged by FedEx, maximum declared value without insurance is $100 per FedEx policy. In addition, Mosquito Control Technology's liability for warranty claims shall not, in any event, exceed the invoice price of the product claimed defective, nor shall Mosquito Control Technology be liable for delays in replacement or repair of products. No waiver, alteration, addition, or modification of the foregoing warranties shall be valid unless made in writing and signed by an executive officer of Mosquito Control Technology. The Free Return Shipping program will only apply to customers who have paid for their machine(s) to undergo the “Exclusive 13 Point Diagnostic Check” and approved the Estimated Repair total. If diagnostic is not performed, Mosquito Control Technology WILL NOT be responsible for return shipment of undiagnosed machine(s). Machine(s) will be sent back at customers expense, either standard FEDEX Ground, or standard FEDEX Ground C.O.D. to be decided solely at Mosquito Control Technology's discretion. No alteration of the foregoing statement shall be valid unless made in writing and signed by an executive officer of Mosquito Control Technology. No salesperson, representative or agent of Mosquito Control Technology is authorized to make any alteration to the Free Return Shipping program. Parts Warranty Information All Parts (Excluding Batteries, see below) are provided "AS IS" without warranty of any kind, either expressed or implied, oral or written, statutory or otherwise, including any implied warranty of merchantability or fitness for a particular purpose. There is no guarantee that any given unit will work or perform to factory expectations upon tune-up completion. Any necessary repairs will be subject to additional cost.
